MOSCOW, September 12 - RAPSI. Trio Invest, part of Miratorg Agribusiness Holding, filed an appeal against a court decision to dismiss a lawsuit seeking the recovery of $66.45 million from Assmann Beraten+Planen, which designed a storage facility for the plaintiff near Domodedovo, Moscow Region, the Moscow Commercial Court told the Russian Legal Information Agency (RAPSI/rapsinews.com) Wednesday.

In July, the Moscow Commercial Court ruled against Trio Invest's $65 million lawsuit and in favor of Assmann Beraten + Planen in the case.

Trio Invest, part of Miratorg Agribusiness Holding, sought to recover losses incurred due to the partial collapse of the warehouse.

In February 2008, the walls and the roof partially collapsed in the 15,000 square foot facility.

The plaintiff sought 1.274 billion rubles ($40.64 million) in losses and over 808 million rubles ($25.77 million) in lost profit.

The court heard a number of companies as third parties, including foreign companies which participated in the project's development, and Nord-Bank, which was liable under a bank guarantee.

Assmann Beraten + Planen is a German consulting and industrial design office. Its Russian projects include the design of the Volkswagen assembly plant in Kaluga.

Established in 1995, Miratorg is a vertically integrated holding company and a major operator on the Russian beef market.
