MOSCOW, July 23 - RAPSI. On Monday the Moscow Commercial Court dismissed Trio-Invest's $65 million lawsuit against Assmann Beraten + Planen, which had designed a storage facility for the plaintiff near Domodedovo, Moscow Region, the court told the Russian Legal Information Agency.

Trio-Invest, part of the Miratorg agribusiness company, sought to recover losses incurred due to the partial collapse of the warehouse.

In February 2008, the walls and the roof partially fell in on the 15,000 square foot facility .

The plaintiff sought 1.274 billion rubles ($39.32 million) in losses and over 808 million rubles ($24.94 million) in lost profit.

The court involved a number of companies as third parties, including foreign companies which participated in the project's development and Nord-Bank, which made payments under bank guarantee.

Assmann Beraten + Planen is a German consulting and industrial design office. Its Russian projects include the design of the Volkswagen assembly plant in Kaluga.

Established in 1995, Miratorg is a vertically integrated holding company and a major operator on the Russian meat market.
