MOSCOW, June 28 - RAPSI. The Supreme Commercial Court has refused to uphold an appeal by the Rusal Krasnoyarsk company on the rules of the wholesale energy market, the court told the Russian Legal Information Agency.

The applicant requests the court to invalidate two paragraphs of the wholesale energy market regulations. The regulations were adopted by the government decree pursuant to the law on power engineering.

Rusal Krasnoyarsk reported that it had entered into a power sale and purchase agreement with Krasnoyarsk Hydro Power Plant on the wholesale market.

But since the regulations have provided for a markup of energy prices, the applicant was forced to pay an extra 914.8 million rubles ($27.82 million).

The applicant claims the provisions of the regulations do not correspond with the law on power engineering and do not comply with trade market access conditions, established by competition law.

The court decision reads that the act in dispute was adopted by the Russian government within the limits of its authorities and pursuant to the law on power engineering.

Rusal is a leading global aluminum producer. It accounts for roughly 10 percent of the world's aluminum production.
