MOSCOW, November 10 - RAPSI, Alyona Yegorova. A commercial court shelved until November 15 a lawsuit filed by the KD Avia airline to recover $82.6 million in unjust enrichment from a construction company, the Russian Legal Information Agency (RAPSI) reported from the court on Thursday.

KD Avia was based in Kaliningrad, Russia. It operated from 2002 until 2009. KD Avia operated scheduled flights within Russia, the CIS and Europe from the Khabarovo airport in Kaliningrad.

KD Avia and the GS Corporation entered into a contract in 2004, whereby the GS Corporation was to construct terminals at Kaliningrad's airport.

KD Avia paid for the work, but later argued that the contract was invalid because it was incomplete. Neither the subject, nor the contract terms had been agreed upon in the contract, the company said. KD Avia sought to recover the sum as of February 2007. The lawsuit was filed with the commercial court in September 2009.

On Thursday, the court requested the airline to recount the interest. As a result, the hearing has been postponed until November 15.
