MOSCOW, February 8 (RAPSI) – The Tverskoy District Court of Moscow had ruled not to proceed with three more lawsuits seeking free replacement of iPhone batteries and compensation for moral damages from Apple’s subsidiary Apple Rus, the court’s press-service told RAPSI on Thursday.

According to the court’s spokesperson, the plaintiffs demanded free repair of the products, that is a service having monetary value. However, the plaintiffs failed to indicate this value in their total monetary claims thus rendering the court unable to determine the jurisdiction of the plaintiffs' claims.

In January, the court ruled not to proceed with 4 similar lawsuits for the abovementioned reasons. The plaintiffs have to correct the lawsuits before February 15.

On January 16, the first lawsuit was filed against Apple Rus. A plaintiff demanded free battery replacement and 777,800 rubles (about $13,700) in compensation from the defendant. Later it was revealed that two of four lawsuits seek 832,800 rubles (about $14,700) as compensation for moral damages.

Earlier, Apple corporation confirmed that the processing speed of older iPhones reduces with time. However, that is needed for extension of the phones’ service life, according to the company. In December, following the statement, two class action suits were filed against the corporation with the U.S. courts.
