MOSCOW, August 17 (RAPSI) - The president of Russkoye Moloko, a dairy company, Vasily Boiko-Veliky, filed an appeal against the court’s dismissal of a lawsuit against Google Russia and Google Inc. on protection of a business reputation, according to the Pravosudiye commercial case database.

The appellant is disputing the June 29 ruling of the Moscow Commercial Court.

According to court records, Boiko-Veliky and Russkoye Moloko (the second claimant) were suing over certain data published online.

Boiko-Veliky and his company claimed that the two defendants posted inaccurate information online but did not substantiate their complaint and did not provide any reference to a relevant law or contract.

The court said that when filing the lawsuit, the claimants failed to provide a reference to a provision of the law or the terms of a specific agreement that would make the companies jointly liable.

The ruling also stated that the defendants were independent companies and thus not responsible for each other’s obligations. “It has been found that the defendants do not have either the legal or technical capacity to influence the publication of any data online, including changes to, removal of or retraction of the information in question.”

During the trial, Russkoe Moloko withdrew the request that Google’s Russian office be fined 200,000 rubles (about $3,050) for posting the disputed information.
