MOSCOW, September 29 (RAPSI) – Kellogg Rus, a subsidiary of the US cereals manufacturer, has filed a complaint with the Voronezh Region Commercial Court against the Federal Tax Service’s decision to collect over 90 million rubles ($2.3 million) in tax arrears from the company, the court told RAPSI on Monday.

The company writes in its application that the onetime collection of the above sum or the suspension of its accounts until a court ruling is made would hinder or even stop its operation, doing considerable damage to Kellogg Rus and third parties and endangering the discharge of its obligations to its employees, counteragents and the budget.

The company also writes that Kellogg Rus is a large and stable company, which honors its obligations to counteragents and the budget in a timely manner, and, if it comes to that, has sufficient funds to execute the contested tax service’s decision.

As of June 30, 2014, the assets of Kellogg Rus were estimated at 3.5 billion rubles ($90.4 million), the company said in its application. It also provided a counter security in the form of a bank guarantee issued by Citibank on August 29, under which the bank pledged to ensure that Kellogg Rus would transfer 92.1 million rubles ($2.4 million) to the budgets of the regions where it has its facilities.

Under the Federal Tax Service’s decision of June 26, the company was held liable for a tax offence and was instructed to repay tax arrears on the income of foreign organizations in the amount 64.7 million rubles ($1.67 million), 8.2 million rubles ($211,780) of fines and 18.9 million rubles ($488,120) in penalties.
