MOSCOW, December 20 - RAPSI. The Ninth Commercial Court of Appeals has dismissed opposition leader Alexei Navalny's appeal against the Moscow Commercial Court's dismissal of his lawsuit against the Zamoskvoretsky District Bailiffs Department in which he disputes the inaction of the court bailiffs, the court told the Russian Legal Information Agency (RAPSI/rapsinews.com) on Thursday.

Navalny's representatives failed to attend the hearing, while lawyers of other parties to the trial were present at the court of appeals.

Navalny disputes the court bailiff's resolution to cease the enforcement proceeding in his dispute with Transneft company. According to the court ruling, the company was ordered to provide Navalny, a minority shareholder, copies of protocols of the company's board of directors. Navalny, however, believes that these were not provided in full.

In October the court supported the bailiff's position and dismissed Navalny's claims.

Transneft has been involved in the case as a third party. During the previous hearing, the bailiff's lawyer said the documents were provided in full, in accordance with the decision.

"The documents that the applicant is referring to cannot be given to him, because he does not have sufficient shares to entitle him to their access," the lawyer said.

Navalny is a minority shareholder of several major Russian state-owned companies. In 2010, he filed lawsuits against these companies to access corporate information. The companies argued that the claims amount to nothing more than an abusive attempt to fish for harmful information.

The Moscow Commercial Court upheld Navalny's lawsuit in February. It obligated Transneft to provide him the minutes of its board meetings. All the appeals courts held in favor of the decision.

As soon as the cassation court passed its judgment in late July, Transneft provided all the documents that Navalny had requested.

Transneft turned to the Supreme Commercial Court with a request to reconsider the lower court decisions on September 1. The three judge panel dismissed the appeal on September 2.
