MOSCOW, October 18 - RAPSI, Diana Gutsul. The Tverskoy District Court judge who is presiding over the case of former pre-trial detention center deputy warden Dmitry Kratov who is accused of dereliction of duties in Sergei Magnitsky's death, has refused to order an inspection of Matrosskaya Tishina jail, the court told the Russian Legal Information Agency (RAPSI/rapsinews.com) on Thursday.

The court has turned down a motion by Magnitsky's mother who insisted that the premises and conditions in which her son was held be inspected. According to her representative, Nikolai Gorokhov, such an inspection could have helped reveal the truth. The prosecutor, the defendant and his attorney were against the motion saying that the circumstances of the case have been established. Kratov has also noted that the detention center now looks quite different.

Magnitsky, a Hermitage Capital Management Fund auditor, was charged with planning large-scale corporate tax evasion. He died in a pretrial detention center on November 16, 2009 after spending a year behind bars. He spent most of his time in detention in Butyrka jail.

His death sparked a public outcry.

The holding center's doctor, Larisa Litvinova, was also a defendant in the case. On April 9, the Investigative Committee reported that the case against her was dismissed due to a Criminal Code revision that reduced the statute of limitation for her offence.
