MOSCOW, July 19 - RAPSI. The Supreme Commercial Court has again refused to reconsider the judgment prohibiting Avtologistika from importing BMW spare parts as it is not an official BMW dealer, the court told the Russian Legal Information agency.

The appeal was filed by EmEx Group, UAE, which acts as the third party.

The court had denied Avtologistika the chance to refer the case to its presidium for review under supervisory procedures on June 9.

The dispute between Bayerische Motoren Werke Aktiengesellschaft (BMW AG) and Avtologistika began in late 2010 with two lawsuits filed by BMW over the parallel import of its spare parts. The first was lodged with the Moscow Commercial Court, and the second with the Moscow Regional Commercial Court. The first lawsuit was dismissed.

BMW AG sought to ban Avtologistika from importing and selling goods bearing its trademark. The motor company also sought to destroy the spare parts imported by Avtologistika and to collect 300,000 rubles (approx $9,300) in damages.

Established in 1913, BMW initially produced aircraft engines. After purchasing a car factory in Eisenach, it began manufacturing cars. Its annual average output around the world is over 1.5 vehicles and 100,000 motorbikes. The company also owns the Mini and Rolls-Royce trademarks.
