MOSCOW, April 12 - RAPSI. A Moscow district court has refused to hold a patent expert appraisal in considering the lawsuit filed by Russian inventors Vitaly Pilkin and Vladimir Miroshnichenko requesting to prohibit Sony Electronics from selling the PlayStation Vita console in Russia.

According to the lawsuit in 2009 Pilkin and Miroshnichenko patented an invention which they consider identical to the PlayStation Vita. They submitted a claim to Sony Electronics to no avail.

Pilkin and Miroshnichenko want the court to recognize that Sony uses their intellectual property and order the defendant to stop Vita distribution and advertizing in Russia.

The inventors' request for an expert appraisal of the console and their invention similarity was dismissed at the Wednesday hearing.

Sony Electronics requested to postpone the proceeding until the Federal Service for Intellectual Property, Patents and Trademarks declares the plaintiffs' patent valid or invalid. According to the defendant, such decision was to be made on May 24. But their application has also been dismissed.
