ST. PETERSBURG, November 11 - RAPSI. A commercial court will hear on December 5 a lawsuit by the Territorial Generating Company TGK-1 against the Federal Tax Service to cancel its decision on supplementary tax assesment worth $26.09 million, the case materials read.

TGK-1 comprises 55 power plants in St. Petersburg, Karelian Republic, Leningrad and Murmansk Regions. Its aggregate electric power capacity is 6315 MWt, thermal capacity - 14362 Gcal/h.

TKG demands that the tax service's May 2011 decision be cancelled. The service charged the company supplementary profit tax for 2007 worth 179.5 million rubles ($5.88 million), 35.6 million rubles ($1.16 million) for 2008 and 428.8 million rubles ($14.05 million) for 2009.

The tax services also charged 33 million rubles ($1.08 million) in penalties, 37.6 million rubles ($1.23 million) in fines and VAT for 2007 amounting to 72.4 million rubles ($2.37 million) and water tax for 2007-2008 worth 9.5 million rubles ($311,385).

The commercial court suspended the tax service's decision in October.
