MOSCOW, October 28 - RAPSI, Alyona Yegorova. An appeals court has upheld the decision dismissing a lawsuit to invalidate a tender for electronic trading facilities for public procurement, the plaintiff's counsel told the Russian Legal Information Agency (RAPSI).

The Ninth Commercial Court of Appeals has held against an appeal filed by Fabrikant.ru against the Moscow Commercial Court's April 19 judgment dismissing its lawsuit.

Fabrikant.ru took part in the disputed tender, but did not succeed. The plaintiff sought a reversal of the tender results arguing that the selection of electronic trading facilities was biased. The defendants, i.e. the Federal Antimonopoly Service and the Economic Development Ministry, organized the tender.

Fabrikant inter-sectoral trading system was developed in 2006 for electronic auctions, including for on-line public procurement, trading and procurement for the nuclear industry and disposal of debtors' assets as part of bankruptcy proceedings.
