MOSCOW, August 18 - RAPSI, Sergei Feklyunin. A claim filed by Beryozka Villa Community against the Moscow authorities was remanded for reconsideration, the court told the Russian Legal Information Agency.

The developer is seeking roughly 2 billion rubles ($69 million) in compensation and demands to terminate an investment contract.

The claimant maintains that the Moscow government violated a shared construction agreement signed on December 28, 2005. The dispute centers on the failed construction of a mixed-use complex in central Moscow.

Beryozka is seeking 1.845 billion rubles in losses and 127 million rubles for unjustified enrichment.

The defendant’s lawyer claims that the suit should be dismissed as the Moscow government was not a party in the agreement.
Meanwhile, Beryozka maintains that the claim is legal as the Moscow Construction Investment Programs Department signed the contract on behalf of the Moscow authorities.

The Moscow Commercial Court partially held for Beryozka in February.
