MOSCOW, May 5 (RAPSI) – The Moscow Commercial Court has dismissed the lawsuit filed by Ferrero Russia, the official representative of the Ferrero Group in Russia, to collect 10 million rubles (about $280,000) from Otkritie Bank, RAPSI learned in court Monday.

A Ferrero spokesperson said at the hearing that in summer 2012, the confectionery producer signed a contract with Russian developer Monolit-Stroy for the construction of a building. The attorney did not specify the address or the intended purpose of that building. He said the construction was never completed and the unfinished structure would have to be dismantled.

The plaintiff  has asked the court to collect 9.5 million rubles in advance payment, 140,000 rubles in spending on the examination of quality standards and of the volume of finished work, and 356,000 rubles in penalties from the contract’s guarantor, Otkritie Bank.

A representative of the bank argued that the bank guarantee cited by the plaintiff appears to be fraudulent.

Ferrero Group of Italy’s Ferrero S.p.A. opened an office in Russia in 1995. It sells Raffaello and Ferrero Rocher chocolates, Kinder products, Nutella hazelnut spread and Tic Tac breath mints. Its official representative is Ferrero Russia.
